Hate speech: Pune court asks police to book Owaisi

A magistrate court, hearing a private complaint of two Pune residents, has directed the Pune city police to lodge an offence against MIM MLA Akbaruddin Owaisi for his alleged hate speech in December in Andhra Pradesh.
Judicial Magistrate (First Class) K P Jain Desarda passed the order on February 11 following a private complaint from Ganesh Bhokre of Shaniwar Peth and his friend Vrushabh Singhavi of Dhankawdi.
Bhokre, a Maharashtra Navnirman Sena (MNS) activist, who had contested civic elections clarified that his complaint against Owaisi was private matter and had nothing to do with his party.
Advocate Sangramsinh Desai who filed the complaint on behalf of the complainants on January 30, 2013, said, "We filed a private complaint in the magistrate court demanding that an offence be lodged against Owaisi for his hate speech in Adilabad on December 24, 2012. We also demanded that an offence be registered against 4TV & Entertainment Channel in Hyderabad for airing the hate speech," said advocate Desai.
" We demanded that an offence be registered under section 121 (waging, or attempting to wage war against Government of India), 121A, 124, 125, 153 (a), 153 (b), 196, 200, 298, 504, and 505 of Indian Penal Code (IPC) and section 67 of Information Technology (IT) Act. We demanded a proper investigation and punishment as per relevant provisions under the law," he added.
The magistrate court passed the order stating, "prima facie, the offences have been committed by the accused. Hence, the police station station concerned is directed to register the crime against the accused for the sections mentioned herein under section 156 (3) of CrPC and file a report within the stipulated time."
Advocate Desai said as the complainant is a resident of Shaniwar Peth, the offence will be registered at Vishrambag police station. "The court has directed police to investigate the case and submit the report before May 13, 2013," he said.
