Pinki Pramanik, the 26-year-old former middle distance runner, is planning to file a defamation suit against the police and additional public prosecutor, who reportedly submitted the medical report declaring the athlete a "male" in a Barasat court.
The police had filed a chargesheet against Pinki based on the opinion of a seven-member medical board that had been constituted at the state-run SSKM hospital.
"I will soon file a case against the police and government lawyer for defaming me and trying to outrage my modesty. Whatever there is in the medical report, that should be with the court, and the police or anyone else is not allowed to open it. Then how come the police filed a chargesheet based on that report? The allegations made by the accuser have been taken at face value and she was never put under the scanner. The police have been very biased in this case from the very beginning. But I have faith in judiciary and will fight my case in the court of law," Pinki told The Indian Express .
"I have the support of my employer (Eastern Railways) and general public, and will fight till the end," the athlete added.
The police chargesheet accused Pinki of rape, torture, cheating, cohabiting with the promise of marriage and holding out threats to the athlete's former live-in partner, who filed the complaint.
Pinki was arrested on June 14 and was released on bail on July 11. A medical board was formed to determine the athlete's gender and the samples for karyotyping (a chromosomal test) were sent to a laboratory in Hyderabad where the examination was done.
