Saji Mohan case adjourned to Jan

The case against IPS officer Saji Mohan who has been booked under a case under the Narcotic Drugs and Psychotropic Substances (NDPS) Act was adjourned to January 14, 15 and 16 even though the case had been listed for its final verdict on Wednesday.

The counsel for the accused, K Bala Krishna, said, "At the time of drafting the order, it was realized that charges pertaining to the delivery of contraband from the residence of Saji Mohan to Nasser Chand were not added."

"Hence, the court asked the defence and the prosecution if they wanted to cross examine the witnesses again. So we then pleaded that it should summon five witnesses," he added.

The five witnesses who have been summoned on the dates decided in January are Viratdatt Chander and Pushpdeep Singh from Customs and three people from the Narcotics Control Bureau (NCB), Prakash Ram (presently posted in Patna), Ganesh and Vijay Kumar (who is presently posted in Jammu).

Thus, this detail was mentioned in Wednesday's order after the framing of the charges alleging that the consignment of heroin was sent to Nasseb Chand from his house took place. The court has summoned the five witnesses who will be cross examined in January.

In March 2009 the NCB registered a case of pilfering with heroin ceased by NCB in which Saji Mohan and four others were arrested in August 2009. All the five accused were booked on charges of pilfering heroin from nearly 13 unclaimed seizures from the storehouse of the NCB headquarters.

On October 2, 2010, charges were framed against Saji Mohan, Balwinder Kumar, NCB Superintendent, Davinder Pal Singh and Naveen Kumar, who are Jammu and Kashmir police constables and a drug peddler Naseeb Chand who was also working as an informer with the Border Security Force (BSF) for heroin pilferage in the case registered by the NCB.

On Wednesday the final order in the case was to be delivered but the case was adjourned to January for cross examination of the five witnesses after an amendment in the charges framed against Saji Mohan.
